Welcome to Sugargrass LLC (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website and the purchase of ingestible consumer products (“Products”).
By accessing or using the Services, or by purchasing Products, you agree to these Terms.
1. Eligibility
You must:
- Be at least 21 years old
- Be legally capable of entering into binding contracts
- Be purchasing Products for personal, non-resale use
We do not sell Products for resale without written authorization.
Unauthorized resale voids any return eligibility and product guarantees.
2. Important Health and FDA Disclosure
2.1 FDA Statement
Unless explicitly stated otherwise:
- Statements regarding Products have not been evaluated by the U.S. Food and Drug Administration.
- Products are not intended to diagnose, treat, cure, or prevent any disease.
2.2 Medical Disclaimer
You acknowledge that:

3. Product Use and Assumption of Risk
You agree that:
- You are voluntarily purchasing and consuming the Products.
- You assume all risks associated with ingestion, including allergic reactions or sensitivities.
- You will use Products only as directed on packaging.
Improper storage, misuse, overconsumption, or combining Products with other substances may increase risk. Sugargrass LLC is not responsible for misuse.
4. Orders and Acceptance
We reserve the right to:
- Refuse or cancel orders
- Limit quantities per customer
- Cancel suspected resale or bulk purchase activity
- Cancel orders suspected of fraud
An order confirmation email does not constitute acceptance. Acceptance occurs upon shipment.
5. Pricing and Payment
All prices are listed in U.S. Dollars.
You authorize us to charge your selected payment method for:
- Product price
- Taxes
- Shipping
- Any applicable subscription charges
We reserve the right to correct pricing errors.
6. Shipping and Risk of Loss
Title and risk of loss pass to you upon transfer to the shipping carrier.
We are not responsible for:
- Carrier delays
- Lost or stolen packages marked as delivered
- Address errors provided by you
For lost package claims, customers must cooperate with carrier investigations.
7. Returns and Refunds
Due to health and safety regulations:
- Opened ingestible Products are not eligible for return unless defective.
- Perishable goods are final sale.
- We may require photographs, lot numbers, and proof of purchase for claims.
Refund abuse may result in account termination.
8. Subscriptions (If Applicable)
Subscriptions automatically renew at the selected interval.
You authorize recurring charges unless canceled before the renewal date.
Failure to cancel prior to renewal does not entitle you to automatic refunds.
We reserve the right to limit repeated subscription refund requests.
9. Anti-Chargeback and Payment Dispute Policy
We take payment disputes seriously.
By purchasing from Sugargrass LLC, you agree to:
- Contact us first to resolve any billing issue before initiating a chargeback.
- Provide accurate and complete information at checkout.
- Not initiate fraudulent chargebacks.
9.1 Fraud Prevention
We use fraud detection systems and may:
- Require additional verification
- Cancel suspicious orders
- Report suspected fraud to payment processors or authorities
9.2 Chargeback Cooperation
If you initiate a chargeback:
- We reserve the right to submit evidence to the payment processor.
- You agree to reimburse us for fees incurred due to fraudulent or bad-faith disputes.
- We may permanently ban your account and shipping address.
Repeated chargeback activity may result in legal action.
10. No Unauthorized Resale
Products are sold for personal consumption only.
You may not:
- Resell Products without written authorization
- Sell on marketplaces (Amazon, eBay, Walmart, etc.)
- Divert Products internationally
Unauthorized resale voids all guarantees and may result in legal action.
11. Reviews and User Content
By submitting reviews, photos, or testimonials, you grant Sugargrass LLC a perpetual, royalty-free license to use such content in marketing.
You represent that your content:
- Is truthful
- Reflects your actual experience
- Does not make medical claims
We may remove misleading health claims.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY U.S. LAW:
PRODUCTS ARE PROVIDED “AS IS.”
WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
We do not warrant:
- That Products will meet specific expectations
- That Services will be uninterrupted
- That Products will be compatible with other supplements or medications
Some states do not allow certain limitations.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Sugargrass LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
This includes claims related to:
- Allergic reactions
- Sensitivities
- Interactions with medications
- Improper use
14. Indemnification
You agree to indemnify and hold harmless Sugargrass LLC from claims arising out of:
- Misuse of Products
- Violation of these Terms
- False statements in disputes or chargebacks
15. Dispute Resolution and Arbitration
Before initiating legal action, you agree to contact us to attempt informal resolution.
Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
You waive the right to:
- Jury trial
- Participation in class actions
Arbitration shall take place in Delaware.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

We are not responsible for delays caused by events outside our control, including:
- Supply chain disruptions

- Regulatory changes
- Natural disasters
- Carrier failures
